2. About Novara
Novara Landscape and Construction is a licensed California landscape contractor (CA LIC #1134876) serving Marin County, Sonoma County, and surrounding areas. We offer landscape design, hardscape installation, retaining walls, patios, driveways, planting, irrigation, lighting, and related outdoor construction services. Founded in 1998, we have completed over 400 projects across our service area.
3. Use of the Site
You may use this Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local laws
- Attempt to gain unauthorized access to any portion of the Site, related systems, or networks
- Use any automated means to access the Site without our prior written consent
- Interfere with or disrupt the operation of the Site or the servers and networks that host it

4. Free Estimates and Consultations
We offer free, no-obligation estimates and consultations for prospective clients. Submitting an inquiry through our website or contacting us by phone or email does not create a binding agreement for services. Any project work will be governed by a separate written agreement signed by both parties.
5. Project Agreements
All landscape, hardscape, and construction work performed by Novara is governed by a separate written contract that will be provided to you before work begins. Such contracts will include the agreed scope of work, materials, pricing, schedule, payment terms, and other project-specific terms. Nothing on this Site constitutes a contract for services or a guarantee of pricing, scheduling, or availability.
6. Workmanship Warranty
Novara provides a two-year workmanship warranty on hardscape construction including patios, retaining walls, driveways, concrete, and walkways. Specific warranty terms, exclusions, and procedures will be detailed in your project contract. Manufacturer warranties on materials transfer separately and are subject to the manufacturer's terms.
7. Photographs and Project Documentation
Unless otherwise agreed in writing, Novara reserves the right to photograph completed project sites for portfolio, marketing, and educational purposes. We will obtain client permission before featuring any project on our website, social media, or marketing materials. Clients may request that their project not be photographed or featured at any time.
8. Intellectual Property
All content on this Site including but not limited to text, graphics, logos, photographs, 3D renderings, designs, and software is the property of Novara Landscape and Construction or our licensors and is protected by United States copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.
9. Third-Party Links and Services
Our Site may contain links to third-party websites, services, or tools. We do not control these third parties and are not responsible for their content, privacy practices, or terms of service. Your use of any third-party site is at your own risk and subject to the terms of that third party.
10. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Information on the Site including pricing ranges, timelines, and project examples is provided for informational purposes only and may change without notice.
11. Limitation of Liability
To the fullest extent permitted by California law, Novara Landscape and Construction shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any information provided through it. Our total liability arising from your use of the Site shall not exceed one hundred dollars ($100.00). This limitation does not apply to liability arising under contracts for services we perform, which are governed separately.
12. Indemnification
You agree to indemnify, defend, and hold harmless Novara Landscape and Construction, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from your misuse of the Site, your violation of these Terms, or your violation of the rights of any third party.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Sonoma County, California, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after any changes indicates your acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
